TERMS AND CONDITIONS
Attendance
Regular attendance is required. There are minimum attendance requirements to satisfy student visa requirements. All bookings made for students during the course are to be attended by the student otherwise additional costs will be incurred.
Fees
Fees are correct as of January 1, 2011.
Basair Aviation College reserves the right to vary its fees at any time. Fees may change without prior notice. All amounts shown are in Australian dollars.
Course fees quoted in information packs are based on allocated hours. Any additional flying, theory, theory exams, flight tests or other materials will incur additional costs.
Expulsion
Basair Aviation College reserves the right to expel students for serious breaches of discipline.
Cancellation / Withdrawal / Refund
Applicant acknowledges that they are enrolling in a complete course of study, and are not purchasing a collection of flying hours.
If a cancellation is made up to eight (8) weeks prior to the start of the course then 50% of the application fee will be refunded.
Cancellation inside the 8-week period prior to the start of the course, does not qualify for a refund.
If a student is refused a visa for study in Australia then the application fee will be refunded in full within four (4) weeks after a written claim is submitted by the student, along with copies of the original visa application and the refusal letter from the Australian Embassy or Consulate. This provision will only apply when the written claim is received by Basair at least two (2) weeks prior to the start of the course.
Students having been accepted by the College but subsequently withdrawing after commencing a course have their tuition fees refunded according to the following:
1)Withdrawal up to the conclusion of week 5 of the course will entitle the student to a refund of 70% of the total course fee.
2)Withdrawal up to the conclusion of week 10 of the course will entitle the student to a refund of 50% of the total course fee.
3)Withdrawal after the conclusion of week 10 of the course will not entitle the student to a refund.
If payment is being made according to Option 1 (above) then the student is not eligible for a refund once the course has commenced.
Where a student withdraws from a course the refund will be paid 4 weeks after the date the College terminates the student, or that the student advises the College in writing that they have withdrawn. In other circumstances the refund will be paid within 2 weeks. Students applying for a refund must do so in writing to the College mailing address.
No refund will be given to any student who breaches their visa conditions or fails to meet course requirements.
Students undertaking an English language (ELICOS) course prior to starting a course with Basair will be considered a Basair student from the commencement of their period of study in Australia.
This refund policy is in accordance with the provisions of the ESOS Act 2000 and the ESOS Regulations 2001.
Course fee payment schedule - Australian Students
An option is available to pay according to the following (Option 1):
1) On enrolment: course application fee, and
2) On course commencement: 20% of total course fee, and
3) Eight equal monthly instalments of 10% of the total course fee, starting one month after course commencement.

Course fee payment schedule - International Students
Course fees are paid according to the following schedule:
1) On enrolment: course application fee, and
2) On course commencement: 40% of total course fee, and
3) At the commencement of week 6: 30% of total course fee, and
4) At the commencement of week 12: 30% of total course fee.

Proceedings arising out of this contract
This contract shall be governed by the laws of New South Wales and any dispute arising out of this contract shall be dealt with in New South Wales

ACKNOWLEDGEMENT
I acknowledge that all the information provided in this application is correct.

I have read the section concerning cancellation and refunds and declare that I understand and accept the terms and conditions therein.
I agree that, if the College accepts my application I will commence the course of training, and make payments according to the payment schedule detailed on the next page.

I have read all information concerning the course I am applying for including the information package and pre-enrolment information. I am aware of course fees and I have sufficient funding to pay for course fees.

I hereby give the College permission to pass my relevant information concerning any results and progress at the College to my Parents/Guardian (if applicable).

I understand that the information provided by me in this application may be made available to Commonwealth and State Agencies, and the Fund Manager of the ESOS Assurance Fund pursuant to the obligations under the ESOS Act 2001 and the National Code. I understand that Basair Australia Pty Ltd is required under Section 19 of the Act to notify the Department of Immigration of certain changes to a student’s enrolment, any breaches of the student’s visa conditions, attendance record and satisfactory academic performance.
This agreement does not remove the right to take further action under Australia’s consumer protection laws. Basair Australia’s dispute resolution process does not circumscribe the student’s right to pursue other legal remedies.
